Terms of Service
These Terms of Service ("Terms") are an agreement between you and Care-e-oke ("Care-e-oke", "we", "us") and govern your use of the Care-e-oke website and apps (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Who may use the Service
You must be at least 18 years old and able to form a binding contract to create an account and use the Service. The Service is intended for adults to share recordings privately within their own families. By using the Service you confirm that you meet these requirements.
What the Service is
Care-e-oke lets you record or upload videos and audio and share them privately with the families you belong to or manage. Recordings are private to those families and are not made public by the Service.
Your account
You are responsible for the activity that happens under your account and for keeping your sign-in credentials secure. Let us know promptly if you believe your account has been used without your permission. You may have different roles in different families (for example, a manager who invites and organises, or a contributor who adds recordings); the features available to you depend on your role.
Acceptable use
You agree not to use the Service to create, upload, share, or store content that:
- is unlawful, or that promotes or facilitates unlawful activity;
- sexually exploits or endangers a child in any way, including child sexual abuse material (CSAM) or any sexual content involving a minor. This is strictly prohibited and there are no exceptions;
- harasses, threatens, defames, or incites violence or hatred against any person or group;
- infringes anyone else's intellectual property, privacy, or other rights, or that you do not have the right to share;
- contains malware, or attempts to gain unauthorised access to the Service, other accounts, or our systems;
- impersonates another person or misrepresents your affiliation; or
- attempts to disrupt, overload, scrape, or reverse-engineer the Service.
You are responsible for the content you add and for having the necessary rights and permissions to share it with your families.
Content moderation and child-safety reporting
You acknowledge and agree that content you upload is automatically screened for potential policy violations using automated content-moderation technology, and that content may also be reviewed. Content that is flagged may be withheld pending review, and we may remove content or suspend access that we believe in good faith violates these Terms.
Child safety. If we detect or otherwise become aware of apparent child sexual abuse material, we will report it to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement as required by law (including 18 U.S.C. § 2258A), and we may be required to preserve the related material for a period even after an account is deleted. We take this obligation seriously and enforce it without exception.
Your content and the permission you give us
You keep ownership of the content you upload. To operate the Service, you give us a limited, non-exclusive permission to host, store, process (including format conversion and the automated safety screening described above), and display your content solely to provide the Service to you and the families you share it with. This permission ends when you delete the content or your account, except for content we are required to retain for legal or safety reasons as described in the Privacy Policy, and copies that may remain in secure backups for a limited period.
Deleting your account and ending the Service
You can stop using the Service at any time, and you can delete your account from your account settings. Account deletion has a 30-day grace period during which you can restore your account; after that, your content is permanently deleted, as described in the Privacy Policy. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its users.
Service provided "as is"
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that content will always be available. You are responsible for keeping your own copies of recordings that matter to you.
Limitation of liability
To the fullest extent permitted by applicable law, Care-e-oke will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service. Nothing in these Terms limits any rights you have that cannot be limited or excluded under applicable law.
Changes to these Terms
We may update these Terms as the Service changes or as required by law. When we make significant changes, we will update the "Last updated" date above and take reasonable steps to let you know. Continuing to use the Service after changes take effect means you accept the updated Terms.
